Terms of Service

These Terms of Service ("Terms") govern your use of the Lifer mobile application ("App"), operated by NTRA Pty Ltd (ACN 697 386 351) ("we", "us", or "our"), an Australian company based in Newcastle, New South Wales. By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account or using Lifer, you confirm that you are at least 18 years of age and agree to these Terms and our Privacy Policy. The App is intended for adults and is not directed at children. If you are using the App on behalf of an organisation, you agree to these Terms on behalf of that organisation.

2. Description of Service

Lifer is a gamified bird-watching app for iOS and Android. Users photograph birds, build personal collections, compete on leaderboards, and can connect with friends to see each other's captures. The App uses artificial intelligence to identify bird species from photographs submitted by users.

3. User Accounts

You must create an account to use Lifer. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@liferbirding.com if you suspect unauthorised use of your account.

4. Your Content

By submitting photos or other content through the App ("User Content"), you grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and display your User Content solely for the purpose of operating, providing, and improving the App. This includes displaying your captures on community maps and heatmaps and, where you use our social features, making them visible to friends you connect with.

This licence is limited to running the App. We do not sell your User Content, and we do not licence or exploit it for separate commercial purposes. You retain ownership of your User Content. You represent that you have the right to submit any content you upload and that it does not infringe any third party's rights.

6. AI Identification

Lifer uses artificial intelligence to identify bird species from photographs. AI identification results are suggestions only, provided for informational and entertainment purposes, and may not always be accurate. We make no warranty regarding the accuracy of species identifications. You should verify identifications independently if accuracy is important to you.

7. Leaderboards and Competition

Lifer features competitive leaderboards. We reserve the right to remove users from leaderboards, disqualify captures, or suspend accounts where we reasonably believe a user has violated these Terms, including through fraudulent captures or artificial manipulation of rankings.

8. Intellectual Property

The App and its original content, features, and functionality are owned by NTRA Pty Ltd and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.

9. Copyright Infringement

If you believe any content on the App infringes your copyright, please notify us at support@liferbirding.com with a description of the allegedly infringing content and your contact information. We will investigate and respond to valid notices in accordance with applicable law.

10. Third-Party Services

The App integrates with third-party services, including Google (authentication and maps), third-party image-recognition providers used for species identification, error and performance monitoring services, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party services.

11. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the App is at your sole risk. Nothing in this section excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.

12. Limitation of Liability

To the maximum extent permitted by applicable law, NTRA Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the App. Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you have paid us in the twelve months preceding the claim, or (b) AUD $100.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability for a breach of a non-excludable consumer guarantee cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.

13. Dispute Resolution

If you have a dispute with us, please first contact us at support@liferbirding.com and attempt to resolve it informally. We ask that you give us at least 30 days to resolve the matter before pursuing other action. Most concerns can be sorted out quickly this way.

Nothing in this section limits any right you have under the Australian Consumer Law to pursue a claim through a court or tribunal, or prevents either party from seeking urgent injunctive or equitable relief from a court.

14. Governing Law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia. Any dispute that is not resolved informally will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

15. Account Termination and Deletion

We reserve the right to suspend or terminate your account for violation of these Terms. You may delete your account at any time through the App (Settings → Account → Delete Account) or by contacting us at support@liferbirding.com. Details of what data is deleted and retained are available on our account deletion page. Upon termination, your right to use the App will immediately cease.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the App. Your continued use of the App after changes take effect constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
